rsyslog use 99% CPU on RHEL 5.4 KVM virtual machine

Issue

We have realized an issue on our RHEL 5.4 KVM based virtual machine while doing an upgrade to RHEL 5.6
RHEL 5.4 system works, but there is a strange issue with rsyslog using 99% of the CPU, while on real HW/VMware rsyslog is at 0%.

Also while performing the upgrade to RHEL 5.6 yum update hangs forever at the first package:
