JBoss A-MQ; receive(timeout) sometimes not timing out when prefetch=0 and maximumRedeliveries=0

Issue

using a prefetch=0 and maximumRedeliveries=0, if a message with a redeliveryCount > 0 arrives at the org.apache.activemq.ActiveMQMessageConsumer (client side) the message is not dispatched to the application code (due to maximumRedeliveries exceeded) but the call to "consumer.receive(timeout)" does not expire.
